The encryption backdoor order saga is far from over despite the appeal's dismissal.
Apple's appeal against a government order to create a backdoor to its cloud encryption has been dismissed by the Investigatory Powers Tribunal.
The Tribunal dismissed the case citing a "change in circumstances", according to court documents viewed by Computer Weekly.
The case surrounded the secret order from the UK Home Office which would require Apple to create a 'backdoor' to its end-to-end encryption service used for personal cloud data storage, Advanced Data Protection (ADP).
Upon hearing the initial order, Apple filed the legal suit to appeal the request, and removed ADP from UK iPhone users rather than impact its encryption.
Since then, the UK Home Office - which continually refuses to comment on the secret order as is the nature of these technical requests - has come under fire from US lawmakers for its attempt to overthrow security.
The initial order was aimed at all ADP users across the globe, which could impact the privacy of every user of Apple's iCloud.
US director of national intelligence Tulsi Gabbard even said that the Home Office had dropped the order, however this was never confirmed by the Home Office and appears to be untrue.
Instead, the Home Office reportedly introduced a new order, with the encryption backdoor order only applying to UK Apple users rather than global Apple users.
With the new order, the initial appeal by Apple has been thrown out by the Tribunal given these changing circumstances.
Apple has yet to comment on it's case dismissal, and has not yet said if it will issue a new appeal.
As of now, ADP is still not available to UK Apple users.
"We are gravely disappointed that the protections provided by ADP are not available to our customers in the UK, given the continuing rise of data breaches and other threats to customer privacy," a spokesperson for the US tech giant said.
